EB-5 Overview: TEA, I-526E, and Investment Risk
The EB-5 Immigrant Investor Program grants permanent residency (green card) to foreign nationals who invest in a qualifying U.S. commercial enterprise and create at least 10 full-time jobs. The EB-5 Reform Act of 2022 significantly reshaped the program's rules.
Three concepts are critical to understand before committing capital: TEA status, I-526 vs. I-526E, and the at-risk requirement.
Targeted Employment Area (TEA)
TEA designation directly determines the minimum investment threshold:
- TEA-designated investment: $800,000 minimum
- Non-TEA investment: $1,050,000 minimum
Post-Reform TEA Determination
Before 2022, states had broad authority to draw TEA boundaries. The Reform Act transferred TEA designation authority directly to USCIS, making TEA qualification more stringent.
A location qualifies as TEA if it is:
- A rural area (outside any MSA), or
- An area with unemployment at least 1.5 times the national average
I-526 vs. I-526E
The 2022 Reform introduced Form I-526E exclusively for regional center investors:

The "At Risk" Requirement
All EB-5 capital must be at risk of both gain and loss. Structures that include:
- Guaranteed buybacks
- Guaranteed returns
- Escrow arrangements shielding capital from actual investment
…may fail the at-risk test and disqualify the petition.
Administrative fees, attorney costs, and placement commissions are not part of the qualifying investment and must be paid separately.
Visa Bulletin and Priority Dates
Turkish-born nationals are generally not subject to EB-5 priority date backlogs, but this can change. Monitor the monthly Visa Bulletin at the Department of State website.
